Whereas
Deborah Rattie (hereinafter called the “Breeder”) offers for sale
a purebred Labrador Retriever described as follows:

*Must
include the kennel name of Freehaven at the beginning. Cannot
exceed 30 characters including spaces, no numbers allowed.
Now therefore ownership will be
transferred to the buyer on the following terms, conditions and
warranties, no other warranties or conditions are either expressed
or implied:
Puppy Contract
-
The
consideration of this sale is $850 + PST
payable in cash, bank money order or by certified cheque
(PAYABLE TO: DEBORAH RATTIE) to be paid before the puppy
leaves the breeder’s possession. Final payment for this puppy
will be a certificate of spay/neuter.
2.
The Breeder, at her expense, will transfer ownership of the
puppy with the Canadian Kennel Club, in the Buyer(s) name(s) and
provide the Buyer(s) with a certificate of ownership once she has
received proof of spay/neuter; said puppy to carry the Breeder’s
kennel name: FREEHAVEN.
3.
This puppy was examined by a veterinarian, been vaccinated
with partial or all shots (depending on age) and dewormed. A
veterinary certificate to that effect is enclosed. The Buyer(s)
agree not to expose this puppy to dogs whose vaccination history
is unknown, nor to areas they may frequent until this puppy has
completed it’s recommended vaccination and booster series. The
Buyer(s) are encouraged, at their own expense, to have this puppy
examined by his or her own veterinarian within 72 hours after
purchase. Failure to do so will relieve the Breeder of all
liability. If the veterinarian finds anything seriously wrong
with the puppy (intestinal parasites or umbilical hernia
excluded), the Buyer(s) may return the puppy for a full refund of
the purchase price if the puppy is returned with a letter signed
by the examining veterinarian indicating the nature of the puppy’s
illness. If the Buyer(s) chose not to return the puppy then the
Buyer(s) waive any and all claims regarding the puppy’s health and
relieve the Breeder from any liability resulting from ill health
of the puppy. After 72 hours, the health of the puppy is the
responsibility of the Buyer(s). The Breeder will not be
responsible for any disease/illness the puppy contracts after
leaving her possession. All veterinarian, shipping/traveling and
other expenses incurred after departure from our kennel, no matter
what the reason (and including the seventy two-hour trial period)
are the responsibility of the Buyer(s). Within the first 30 days,
if the puppy is returned due to allergies, family breakdown,
relocating or any other reasonable cause, the Buyer(s) will
receive a refund of 50% of the purchase price. Canadian Kennel
Club registration papers must be returned and ownership must be
signed over to the breeders.

This
animal is guaranteed against hip dysplasia and elbow dysplasia
up to the age of 26 months. The Breeder shall
a) provide a replacement
puppy (as soon as one is available) to any animal that has to be
euthanized on a qualified veterinarian’s recommendation due to
severe/crippling dysplasia before the age of 26 months OR
b) if the Buyer(s)
elects to have surgery done on the animal, a one time only
payment of $400.00 will be given (acceptance of the cash payment
forfeits replacement puppy). A second x-ray by another
unassociated veterinarian may be required before a replacement
or payment is given. If it is found that there was excessive
stress previous to the 26 months of age (i.e. jogging, jumping,
overweight, pregnancy etc) or if a male pup has been neutered
before 10 months of age/a female has been spayed before 6 months
of age; the above guarantee does not apply. Results from the
Penn-Hip exam are not accepted. This animal is also guaranteed
up to five years of age against Progressive Retinal Atrophy
(PRA). The Breeder will not be responsible for the development
of any non-genetically derived disqualifying faults, diseases or
disorders. Also any conditions which are due to the Buyer’s
negligence. Any other replacements
are at the Breeder’s discretion. NO REFUNDS WILL BE GIVEN.
All veterinary, transportation expenses etc. will be paid by
the Buyer(s).
5.
The Breeder requires that the puppy be fed a quality
adult food (see enclosed
Health Report). No large breed puppy or adult food. If the dog is fed regular puppy, low quality food or
large breed puppy, the guarantee is null
and void. The Breeder requests that all UPC codes and dated
receipts be kept from bags of dog food as proof of type of food
fed.

Pet
puppies to be spayed/neutered (see enclosed article) by the age
of 12 months. Where applicable, the Buyer(s) agrees to sign a
Canadian Kennel Club Non-Breeding Contract as of the date
hereof. The Buyer(s) agrees that he/she will not use the herein
animal for breeding. Anyone wishing to breed this animal must
sign a separate breeding contract. The Buyer(s) agrees that if
a breeding (planned or accidental) should occur, they will be
subject to a breach of contract fine of $5,000.00.

The Buyer(s) states
that he/she is not acting as an agent in the purchase of the
puppy, and will not be sold to an agent or pet store nor will
this dog be sold or given away to be used as a prize or a
raffle.

The
Buyer(s) agrees that if for any reason he/she must dispose of
the herein puppy, the Breeder will be notified before any such
action is taken. The Breeder will have the right of the first
refusal to purchase the animal at the original purchase price
(minus expenses) or assist in relocating the animal to a
suitable home.

The Breeder will not
be responsible for any debts or expenses incurred by the Buyer(s)
for any reason.

The Buyer(s) release
and agree to hold the Breeder harmless from any and all
liability for injuries or damages to person or property caused
by the dog while in the possession or care of the Buyer(s).
-
The Buyer(s) agree
to inform the Breeder when they move or change phone numbers,
within 30 days of such change, for the life of the dog.

The Buyer(s) agrees
to keep the animal in the proper physical condition, to keep all
vaccinations up to date and to provide a safe environment for
the animal (i.e. kennel run, fenced yard, not running loose).
If in the opinion of the Breeder, the animal is at risk due to
actions of the Buyer(s), the Breeder will repossess the animal
with full, partial or no refund of the purchase price (Breeder’s
discretion). All papers including the CKC registration
certificate will be returned to the Breeder at the time of
repossession.

Should it be
necessary to enforce any part of this contract by legal means,
all expenses will be the responsibility of the Buyer(s). No
part of this contract is transferable.
This contract is binding upon the
parties hereto, their heirs, successors and assigns.
No provision of this contract may be
altered or amended without written approval of both the Buyer(s)
and Breeder.
It is understood and agreed that the
Buyer(s) by signing this contract, has read and understands fully
all provisions of this contract.

Part 2
Genetic Defects
NO BREEDER can ever
produce 100% healthy-for-life dogs.
As a breeder, I have
made every effort to ensure that my puppies will grow up to be healthy,
sound dogs and I’ve taken advantage of what is readily available to me by
way of x-ray certification, ophthalmologist testing, DNA testing and
studying pedigrees of all my stock before breeding to ensure the best
puppy that I can produce. As we are all aware though, there are no
guarantees in life, unforeseen tragic events happen to everybody and
everything all the time. Due to
the complex genetic interactions and environmental factor’s beyond our
control I cannot guarantee that a puppy purchased from Freehaven Kennels will be
totally free of genetic disorders, there is
always going to be a small risk of some genetic problems cropping up.
By signing this statement I/we
hereby acknowledge that an outline of some of the possible genetic defects
have been explained and I/we understand that there is a small risk of a
genetic defect.
